PUBLIC HEARINGS/PLANNING REFERRALS AND APPEALS --Audience participation is encouraged.

1. Cases P08-0402 and P08-0403 - Appeal - Embree Construction Group, Inc. - Planning Commission denial of conditional use permit and design review to establish one-story, 8,142-square-foot Firestone tire shop with installation and minor repair on approximately .9-acre lease space within 3-acre “Orangewood Centre” commercial center under construction - 18580 Van Buren Boulevard (Ward 4)

2. Public Comment Period - This is the portion of the meeting specifically set aside to invite your comments regarding any items on closed sessions, City Council Consent Calendar, joint Consent items with the Redevelopment Agency and Housing Authority, or matters within the jurisdiction of the City Council/Redevelopment Agency/Housing Authority - Individual audience participation is limited to 3 minutes, and you will be asked to state your name and city of residence.

DISCUSSION CALENDAR--This portion of the City Council's Agenda is for all matters where staff and public participation is anticipated. Audience participation is encouraged.

4. Joint item with Redevelopment Agency and Housing Authority - Appropriate Neighborhood Stabilization Program Grant of $6,581,916 from Housing and Economic Recovery Act of 2008 for acquisition and rehabilitation of foreclosed homes for rental or resale to eligible City residents - Neighborhood Stabilization Program Plan and Memorandum of Understanding with Redevelopment Agency and Housing Authority for transfer of properties to Housing Authority acquired with Neighborhood Stabilization Program and Targets of Opportunity Program funds, and Professional Services Agreement with Fair Housing Council of Riverside County for foreclosure mitigation counseling, and implemental strategy to use Target of Opportunity funds to expand efforts to mitigate current foreclosure actions (All Wards)

5. Riverside Renaissance - Transportation Committee recommends approval of preliminary design alternative for Iowa Avenue Grade Separation Project and installation of traffic signals at realigned intersections of east and west Citrus Streets at Iowa Avenue following completion of project (Ward 1)

CONSENT CALENDAR--All matters listed under the CONSENT CALENDAR are considered routine by the City Council and may be enacted by one motion in the form listed below. There will be no separate discussion of these items unless, before the City Council votes on the motion to adopt, Members of the City Council or staff request specific items be removed from the Consent Calendar for separate action.

Removed consent items will be discussed immediately after adoption of the balance of the Consent Calendar.

An Ordinance of the City of Riverside, California, amending Title 9 of the Riverside Municipal Code by adding Chapter 9.60 establishing liability for making a false report of an emergency or of a criminal offense and for extraordinary police services or responses - Councilmember Schiavone recommends referral to Public Safety Committee (All Wards)

9. Case P08-0541 - Jennifer Mermilliod - Designate Walter C. Banks residence of potential North Hill Historic District as City Historic Landmark - A Resolution of the City Council of the City of Riverside, California, approving the application under Planning Case Number P08-0541 designating the structure at 3105 Pine Street, as a City Historic Landmark, Assessor’s Parcel Number: 214-020-012 - Waive further reading (Ward 1)

10. Case P08-0407 and P08-0410 - Aubree and Brian Fuentes, on behalf of Children’s Lighthouse Learning Center - Conditional use permit and design review to establish and operate 10,006-square-foot child care center with up to 193 children and up to 25 staff members on approximately 3.85 acres -

11. Amend 2007-08 and 2008-09 Housing and Urban Development Annual Action Plans to transfer $250,000 and allocate $370,000 of Community Development Block Grant funds for Safe Pathways to Schools Project and Antioch Avenue and Hillside Avenue Street Rehabilitation Project, respectively, to construct additional sidewalks and increase safe passage for Ward 7 students walking to and from school and rehabilitation of Antioch Avenue between Dewey and Hillside Avenues and Hillside Avenue between Arlington and Central Avenues - Funds transfer (Wards 3 and 7)

13. Agreement with Siemens Building Technologies, Inc., for $140,470 from General Services budget for heating, ventilation, and air conditioning preventive maintenance at City Hall, Municipal Auditorium, Orange Police Station, Utilities Operation Center, Main Library, and Riverside Convention Center through June 30, 2009 (Wards 1 and 4)

14. Adopt an Ordinance of the City of Riverside, California, amending Riverside Municipal Code Section 9.05.050B authorizing the City Manager to approve alcohol service in connection with City special events and the use of City facilities for special events - Waive further reading (Intro. on 10-28-08, All Wards)

15. Five-year License Agreement with Concilio Child Development Centers to operate Nati Fuentes Centro de Niños at Bordwell Park - 2010 Martin Luther King Jr. Boulevard (Ward 2)

16. Regulation of poolrooms - Introduce an Ordinance of the City of Riverside, California, amending Sections 5.28.060 and 5.28.080 of the Riverside Municipal Code extending the term of permit and permit renewal and requiring notification upon the sale or transfer of business (All Wards)

17. Request for cancellation of Agreement by Arroyo Engineering Solutions, Inc., for Tequesquite Arroyo Trunk Sewer Project - Agreement with Birge Engineering Corporation for $588,240 from Public Works Department budget to complete environmental documentation, design, permitting, and right-of-way activities - Four-mile sewer line from intersection of Chicago Avenue and Le Conte Drive, wly. through Tequesquite Arroyo, under State Route 91 Freeway, through Riverside Community College campus, to Tequesquite Avenue near Santa Ana River (Wards 1, 2, and 3)

18. Third amendment to agreement with Turbo Data Systems, Inc., for approximately $90,000 annually from Public Works Department budget for parking citation processing and payment services through August 1, 2010, and expanded scope of services to include State of California Franchise Tax Board assistance to collect outstanding citation revenue (All Wards)

19. Revision of various speed limit zones throughout City, removal of existing 40-mile-per-hour speed limit on University Avenue between Iowa Avenue and Chicago Avenue and existing 40-mile-per-hour zone on Overlook Parkway between Orozco Drive and Washington Street, and establishment of 40-mile-per-hour speed limit zone on Overlook Parkway between Bodewin Court and Crystal View Terrace - Adopt an Ordinance of the City of Riverside, California amending Section 10.76.010 of the Riverside Municipal Code designating the prima facie speed limits for streets and portions thereof in accordance with the provisions of Sections 10.20.020 and 10.20.030 - Waive further reading (Intro. on 10-28-08, Wards 1, 2, 4, 5, 6, and 7)
